Terms of Service for Private Commissions
General Terms:
- Prices are subject to change based on demand.
- I have the right to reject any order for any reason.
Payment:
- Currency accepted in CAD and can be paid through PayPal or bank transfer.
- Commissions can be paid 100% upfront or split 50% upfront and 50% after final work approval.
- Don't send any payment until after you have received your invoice and order summary.
Process & Delivery:
- The time it takes me to finish your commission will vary 1 week-3 months depending on factors such as health, the complexity of the commissioned piece, other work...
- Once the piece is finished you will receive a series of photos of the work.
Revisions:
- You get 2 rounds of changes on the commissioned piece included in the price.
- A fee will be added if you want further changes made on the final work.
- If you wish for me to change something in the work you have previously approved, you will be charged a fee. The amount will vary based on the nature of the change.
Copyright & Usage:
I, Alyssa Stoddard:
- I reserve the right to cancel the order at any time for any reason.
- I retain all copyrights over the commissioned artwork.
- I reserve the right to post the commissioned artwork online as well as in publications such as art books.
You, (the customer/commissioner):
- You may upload the commissioned artwork on any website and social channels.
- You may not make any profits from the commissioned piece (reselling, redistributing, make prints etc.)
- You may not alter the commissioned artwork without my (Alyssa Stoddard's) consent.
- You may be allowed to sell the artwork under special circumstances. This must be discussed with me (Alyssa Stoddard) prior to the sale of the artwork.
- You may not use the commissioned artwork for commercial purposes unless specifically specified in the commission order summary by me (Alyssa Stoddard). A fee will be applied for this addition.
The following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
- Claiming the artwork as your own.
- Altering the artwork without my (Alyssa Stoddard) consent.
- In some cases, the commercial rights to the image may be purchased.
Cancellation & Refunds:
- The buyer/commissioner is not permitted a refund once I begin working on the commissioned artwork.
- If for any reason I am unable to start your commission you will receive a full refund.
- If I do give a refund, please do not request a Paypal chargeback. I will transfer your refund directly.
- If you request a Paypal chargeback at any point where you were not permitted a refund you will lose all beforementioned rights to the commissioned piece and I will have the full rights to profit further from it in anyway. I will decline the chargeback and supply Paypal with all communication for proof of agreement and work started.
